Basic Information About Divorce in Maryland and the District of Columbia
Attorney Lloyd A. Malech is licensed to practice law in both Maryland and the District. These two jurisdictions have similar — but not identical — laws regarding divorce procedures.
In both states, a no-fault divorce may be obtained only after a period of legal separation, where the spouses live separate and apart without cohabitation. In Maryland, the time period is one year. In DC, it is six months. If the separation is not mutual and voluntary, those time periods double.
The period of legal separation is not required in cases where the divorce proceeds on grounds other than legal separation. Other valid grounds for a divorce in either Maryland or DC include desertion, adultery, and cruelty.
